摘　　要：医疗事故赔偿是多年来困扰司法领域的一道难题。近年来"医闹"、针对医护人员的暴力事件频频发生,对医疗机构的正常运作和医务人员工作积极性造成了严重的打击;而导致病人及家属采取极端手段来解决问题的一个重要原因,便是医疗事故鉴定和赔偿执行的困难。本文通过剖析新《医疗事故处理条例》及其中的医疗事故鉴定、医疗事故赔偿、精神损害赔偿金、医疗责任保险等问题,提出相应的解决建议。Compensation for medical malpractice is a difficult problem which puzzles the judicial field. In recent years, the frequent occurrence of medical disturbance and violence against health care workers caused serious blow to the normal operation of medical institutions and medical staffs work enthusiasm. And one of the important reasons for patients and their families to take extreme measures to solve the problem is the difficulty in the medical malpractice appraisal and compensation execution. Based on the analysis on the new Medical Malpractice Management Regulations, and the problems such as medical malpractice appraisal, medical malpractice compensation, mental injury compensation and medical liability insurance, etc., this paper tends to find out the reasons, and puts forward corresponding solutions.
