摘　　要：药品侵权责任赔偿诉讼,常援引《药品管理法》和《侵权责任法》相关条款作为赔偿请求法律依据。鉴此,有必要进行体系性研究,以厘清两部法律涉及药品侵权归责原则的关系、侵权责任构成要件、责任主体以及法律适用等。In the cases of drug infringement compensation, the articles in Pharmaceutical Administration Law and The Law of Liability for Infringe to do systematic research on this two components, the liability subject and ment are often cited as legal basis for compensation. Therefore, it is necessary laws to clarify the relationship of drug tort imputation principles, tort liability law application, etc..
