论彝族新型“德古”调解——以小凉山彝区“德古”调解为例

摘　　要：创新纠纷化解和社会管理机制,是当前我国面临的一个重大课题。为了进一步发挥人民调解在化解社会矛盾,创新社会管理机制中的积极作用,小凉山峨边经过不断摸索和实践,逐步走出了一条符合当地实际,具有当地特色的"彝区德古调解"之路。新型"德古"调解是近年来在新形势下开创的凉山彝区人民调解新模式。鼓励、引导和规范当地彝族同胞传统的"德古"调解,使规范后的"德古"调解成为当地人民调解工作体系的重要组成部分。新型"德古"调解实现了传统"德古"调解的转变与超越,注重强化与传统权威组织的良性互动,实现国家法与彝族习惯法的良性互动,构建多元化纠纷解决机制。Innovation to dispute resolution and social management mechanism is a major task in China today. In order to improve the positive role of the people＇ s mediation in social contradiction resolu- tions and social management mechanism, a specific and effective Degu Mediation of the Yi people has been established through continuous exploration and practice in Ebian of Xiaoliangshan area. As a new mode of mediation, it encourages, guides and standardizes the traditional Degu Mediation, mak- ing it an important component of the local mediation. The new mode, based on the traditional one, fo- cuses on the relationship with traditional authorities for benign interactions between state laws and the customary laws of the Yi people, achieving diversified dispute solution mechanisms.
