摘 要:社会合作管制具有独特的内涵和要素,但与社会自我管制、行政高权管制并非是完全替代的关系。在参与治理的推动下,传统的政府高权管制有所缓和,但难以撼动其命令—禁止的管制模式,而社会自治的治理模式则促进了社会自我管制的兴衰。随着参与治理、社会自治模式分别被合作治理模式所替代,今后在合作治理主导下的管制模式无疑将走向社会合作管制的康庄大道。我国社会建设的发展、国家与社会的特殊关系、转型期的权力格局等特殊背景决定了社会合作管制兴起的正当性。As a new mode of regulation,social so-regulation is both the product of reflection on the traditional state regulation and the result of the social self-regulating development trends.However,its unique content and elements do not guarantee its complete replacement of state regulation and social self-regulation.The participation-governance has eased the traditional state regulation to some extent,but its command and control mode is still too strong to be uprooted,while the mode of social self-governance has resulted in the rise and fall of social self-regulation.As participation-governance and social self-governance is being replaced by collaborative governance,the regulation mode guided by collaborative governance will no doubt be social co-regulation,whose legitimacy is safeguarded by the development of China's social construction,the special relationships between state and society and the power structure in transitional China.
