欧肯宪政经济思想的逻辑范式

摘　　要：欧肯阐释的理想经济秩序模式,体现了对制约和影响经济行为者的规则性质的思考,为经济问题的分析增加了一种"宪政"维度,业已触及立宪选择的本质范畴。利己和利他的经济人假设是欧肯进行宪政经济分析所必要的逻辑前提。将实现个人主义运用到经济秩序上,并体现"自由的经济宪政的构想和对权力分析的方法"是欧肯的秩序经济著作的核心。欧肯力图在自由中建立宪政,设想在以自由原则为核心的宪政基础上建立合理秩序——竞争秩序。无论是私人权力还是国家强制权力的垄断统治及其交织更迭,都足以抑制竞争。对两种权力意识反竞争本质的根源性认识,不应拘囿于经济领域本身,而是应该深入到宪政制度构建的层面。欧肯主张建立和维持一种完全竞争下的经济秩序,以求化解权力冲突、协调社会矛盾、实现稳定均衡。国家主导的竞争秩序、理性原则导向的宪政选择、整体关联的竞争秩序原则以及多维结构的竞争秩序政策塑造,实际上嵌入并确立了欧肯宪政经济思想的衍生逻辑的内核。Theidealized model of economic order by Eucken is a reflection of the nature oi rules restricting and affecting the economic participants, which provides a constitutionalist dimension to the analysis of economic issues, touching the essential category of the constitutional choice. The hypothesis of economic man for altruism and individualism is a logical premise for constitutional economic analysis. Applying individualism to the economic order and reflecting the methods of ＂free economic constitutional government power analysis＂ is the core of Eucken＇ s works of economics. Eucken tries to set up a constitutional government in freedom, intending to establish a reasonable order on the constitutional basis, that is, a competitive order. Whether it is private power or monopolizing the rule of the national forceful power, or the alteration between the both, all are enough to function to suppress competition. The knowledge of both anti-competition powers should not be confined only to the economic field, but should go beyond to the level of construction of constitutional system. Eucken argues for establishing and maintaining an economic order for total competition in order to reduce power conflict, coordinate social contradictions and realize balance. Nation-oriented competitive order, the reason-oriented constitutional choice, holistically related competitive order principles and the shaping of multidimensional competitive order policies all help to establish the core of Eucken＇s constitutional economic thoughts.
