摘　　要：美国自16世纪设立大学以来,对大学作为义务的研究已比较成熟和完善,大学作为义务配置基础随着美国大学办学模式的变化而不断的演进着。"替代父母理论"、"合同契约理论"、"不动产权人和应邀来访者理论"对研究我国大学作为义务具有重要的参考价值,我国应在落实大学作为义务配置基础的前提下,以此为指导确立我国大学应承担的各项具体作为义务类型。With the establishment of the universities of the United States in the 16th century, there have been more mature and perfect researches on the university＇s duty of act. With the changes in the patterns of American universities, the foundations of university＇s duty of act have varied accordingly. The theories such as ＂in loco parentis＇,＂contract doctrine＂ and ＂the landlord invitee doctrine＂ are of important reference value. As the obligation theory is a basis of relative legislation,we should draw on the experience of the United States.
