刍议韩国《在外同胞法》的违宪诉讼

摘　　要：1999年,以规定侵犯在外同胞的平等权为由,在韩中国朝鲜族公民对韩国《在外同胞法》提起违宪诉讼;2011年,以实施侵犯在外同胞的平等权为由,在韩中国朝鲜族公民再次提起违宪诉讼。《在外同胞法》无论从其规定,还是实施来看,都违背了历史事实和《韩国宪法》的平等权,韩国应采取有效的措施,进一步重视和保障在外同胞的权益、法律地位和平等权。The lawsuit against Law of Overseas Korean＇s Entry and Their Legal Status has been brought twice in 1999 and 2011 respectively by Chinese Koreans in ROK due to the infringement of the equal right of overseas Koreans. Provisions and the implenmentation of the Law of Overseas Korean ＇ s Entry and Their Legal Status are contrary to historical facts and the right of equality stipulated in Korea＇s Constitu- tion. Korea should take effective measures to focus and protect the interests, the legal status and the equal right of overseas Koreans.
