摘 要:在节会旅游快速发展的今天,民间节会正在由民俗文化走向消费文化,大量的节事活动、节日民俗被包装成可出售的旅游商品。侗族因其特殊的物候与历史条件创造了大量民间节会,具有丰富的节会文化资源。一方面侗族节会旅游取得成功的品牌效用,另一方面侗族节会文化符号在商业开发中被大量盗用而丧失了"本真性"。对节会资源进行知识产权保护,确认侗族节会标志性符号代表物、科学施用节会资源商标注册、科学确认节会知识产权保护的主客体,这既是非物质文化遗产保护的一个发展趋势,也是一种操作技术。In today's world where festival-based tourism is developing fast, folk festivals are changing from folk culture to consumption culture and the festive celebrations and customs become marketable tourist commodities. Due to their unique phenology and historical conditions, the Dong people have very rich festival-based cultural resources. On the one hand, the Dong people's festivalbased tourism has become a successful brand name while on the other hand the cultural symbols of these festivals have lost their authenticity because of exces-- sive misappropriation during the course of business development. Therefore, to protect the intellectual property rights of festival resources, define symbolic signs of these festivals, scientifically utilize trade marks of festival resources, and determine the subject and object of IPR protectxon is not only a development tendency but also an operative technique.
