摘 要:在最新的国务院机构改革方案中,国家进一步明确指示应合理配置宏观调控部门职能,形成科学、权威、高效的宏观调控体系;而宏观调控过程中的权力冲突容易对该政策目标构成障碍。文章以我国宏观经济领域的调控个案为切入点,提出权力冲突这一主题,并从冲突部门化、冲突显性化、冲突博弈化三方面分析权力冲突的表征,进而结合我国宏观调控特有的语境揭示权力冲突的成因。以此为基础,作者就行政和司法两种冲突消解路径进行探讨,力求为克服我国宏观调控权力冲突提供可行思路。During the latest institutional reform of the State Council,the government has made a definite instruction to appropriately divide responsibilities among governmental departments which is on duty to macroeconomic regulation,and form the scientific and authentic system of macroeconomic regulation with high-efficiency.However,the power conflicts between the departments probably will be an important obstacle to the aforesaid policy.Setting some macro-control cases in China as an start point, this paper put forward the subject of power conflict,analyses both the features and causes of the power conflict based on China’s characteristics,and elaborates on the administrative and judicial channels of overcoming abovementioned power conflicts.The author tries to find an practicable answer to overcome these conflicts.
