摘　　要：现行有关农村土地的法律制度存在一定的缺陷,容易造成农村土地承包经营权权属不清,对农村土地承包经营权流转设立缺乏正当理由的诸多限制,增加了流转过程中的交易成本。因此,必须尽快建立健全农村社会保障体系,放宽对农村土地承包经营权流转的限制,并制定农村土地承包经营权入股等具体细则。The current law exists in some deficiencies and is easy to cause the right to rural tana contrac^u management blurry. The restrictions lacking justification have increased transaction cost in the process of transference. We must establish and perfect the system of rural social security, relax the restriction on the transference of the right to rural land contracted management, and formulate the detailed rules for the im- plementation for the right as share capital, and so on.
