摘　　要：在经济全球化浪潮的影响下,越来越多的中国公民迈出国门走向世界。境外中国公民不服领事服务行为的法律救济问题渐入公众关注视野。对领事服务行为的规范化和公民权利救济制度的研究渐有现实意义。领事服务行为符合具体行政行为的构成要件与一般特征,具有对其进行司法审查的必要性。人本主义观念成为突破行政诉讼受案范围的推动力;借助网络技术的远程审判方式也将为司法审查提供客观可能。Under the impact of economic globalization,more and more Chinese citizens go abroad to the world. The issue about legal remedies that overseas Chinese citizens refuse to accept consular services has gradually got a lot of publicity. It is becoming practical significance to standardize the behavior of consular services and to research on the civil rights remedy system. The behavior of consular services accords with the composing elements and the general characteristics of the specific administrative action,and it is of necessity for judicial review. The humanistic idea becomes an impetus to break through the scope of accepting cases in administrative proceeding. With the help of network technology, the remote trial mode will provide judicial review with the objective possibilities.
