摘　　要：在我国,性别平等就业是一个亟待解决的问题,并且也已经进入了立法者的视野。从法社会学、法经济学视角看,是组织利益与国家利益的背离使单位不能自觉促进性别平等就业。而通过制度分析及制度比较,可以发现未来性别平等就业立法的努力方向以及使性别平等就业问题成为法律问题的可能路径。In our country, gender equality in employment is an urgent problem to be solved. This paper, from the perspective of Sociology Of Law, Law And Economics, made a discussion on the mechanism of gender discrimi- nation in employment and offered the gender equality in employment legislation ideal state. At the same time may effect on the legal field and make due reflection
