透视山西煤炭资源开发利用法治化的主要障碍

摘　　要：随着环境与资源保护立法工作的蓬勃兴起,山西省对煤炭资源的相关立法工作也逐步开展起来。但至今仍不完善,而且在相关法律的实施过程中存在着许多的障碍,煤炭资源可持续开发利用法治化的进程也相对缓慢。通过探究与剖析山西煤炭资源开发利用过程中的法治状况,找到执法环节所暴露出来的主要问题,进而找到解决问题的办法,提出可行的法律建议,为山西煤炭资源的可持续开发利用找到一条可行的法治道路。With the booming of the Environment and Resources Protection legislation, the coal resources of the relevant legislation have gradually carried out in Shanxi. However, the system is still far from perfect, but there are many obstacles in the implementation of relevant laws and implementation process, coal resources, sustainable de- velopment of the rule of law, the proces is relatively slow. In this paper, to explore and analyze the coal resources in Shanxi use the rule of law in the process of development, or that is exposed by the law enforcement part of the le- gal operation of legal phenomena and legal issues. The author found the viable legal recommendations practice for sustainable development and utilization of coal resources in Shanxi.
