摘　　要：村民自治组织是一个系统的组织管理体系,它内部包含着权力组织、执行组织、监督组织和最基础组织。村民自治法律制度的设计,为村民自治组织健康运行提供了基本保障,但在村民自治组织的结构关系上还存在法律构架不合理、角色定位不准确、职权分工不明确、运作机制不顺畅等问题,这直接影响到村民自治实践中决策权、执行权、监督权的有效行使。要破除实践的障碍,就得完善村民会议制度、准确定位村民委员会角色、化解村务监督委员会法律制度冲突、强化村民小组的服务权能。The Villagers autonomy organization is a system of systematic organization and management. It consists of organizations of power, execution, supervision, and the most basic organization. The design of the Viilager autonomy~ legal system provides the basic guarantee for the healthy development of villagers＂ autonomous organization. However, about the structural relationship of villager~ autonomous organization there are still problems of unreasonable legal framework, inaccurate role positioning, unclear division of function and power, and unsmooth operation mechanism, which will directly affect the effective execution of decision - making power, executive power, and supervision power in the practice of the villagers＂ autonomy. To break the obstacles of practice, it is required to improve the system of villagers meeting, accurately orient the role of the villagers committee, resolve conflicts of legal system of village committee, and strengthen the powers and the functions of villager groups＇service.
