摘　　要：舆论监督与司法独立是民主法治国家的基石,司法公正的实现离不开有效的法律监督,不受控制的舆论监督可能逾越法律底线,侵害司法的独立审判权,民众传统的法观念是其隐性因素,而对媒体监督法律规制的缺位则是其深层次的诱因,如何平衡舆论监督和司法独立两者的冲突,涉及到法律价值的选择问题。Supervision by public opinion and Ihe independence of the judiciary is one of the cornerstones of the state under the rule of law, the administration of justice needs an effective legal Supervision, the uncontrolled media reports may go beyond the baseline, and infringe on the independence of the judiciary jurisdiction. People＇ s concept of the traditional method is recessive factors, and the absence of legal regulation on media supervision is deep-seated cause. It＇s a legal value choice of how to balance the conflicts of Supervision of public opinion and the independence of the judiciary.
