摘　　要：根据《联合国海洋法公约》第121条的规定,岛屿及特殊类型岩礁享有不同的法律地位,该条文给出了岛屿的定义却没有明晰岩礁的内涵和外延,导致实践中频繁出现岛礁辨析的争议,而岛礁辨析也是海权争夺的先决问题。明确岛屿的"自然属性"和岩礁的"社会经济属性"是界定二者的关键,从岛礁辨析的法律问题出发,运用国际法学基本原理,结合地理学信息以及岛礁事实经济价值加以详细剖析,进一步细化岛礁辨析的标准,以期在实践中为中国主张南沙群岛的海域主权提供理论依据。According to Article 121 of the United Nations Convention on the Law of the Sea, island and rock enjoy different legal status. The provision defines the concept of island but not addressing that of rock, arousing disputes of distinguishing rock from island in practice. Defining whether a geographic feature is an island or a rock directly relates to a costal state＇ s ocean rights. The key to defining islands and rocks is specifying the natural attributes of the islands and the socio-economic attrib- utes of the rocks. This paper, examined the basic principles of international law, analyzed geographic facts and the economic value of the features, with a view to offering a standard for defining islands and rocks as well as providing legal theory for pro- tecting China＇ s sovereign right over the area of the Spratly Islands.
