摘 要:我国现行农村土地征收法律框架下,土地承包经营权尚未被具体明确为独立的征收对象,其权利主体并非征收关系的当事方,对征地过程既无知情权,更无参与权。改革现行征地制度的切口在于厘清土地征收的法律结构,明确土地承包经营权的征收客体地位及其权利主体的征收关系当事方地位,通过征地审批决定的前置听证程序,落实土地承包经营权人的知情权和参与权,按公平补偿原则,确定土地补偿费,并将其中的 80% 直接分配给土地承包经营权人,确证土地承包经营权的准所有权地位。Under the current legal framework of rural land levy, the right to the contracted management of land has not been independent collection of objects. Though the subjects of the right is the main stakeholders, but the parties have no right to know, no more participate. The incision of reforming the current land requisition system is to clarify the legal structure of land levy. Through the approval decision on condition of hearing procedure, the subject's rights to know and participate will be carried out. Then we determine the land compensation fees according to the principle of fair compensation, and 80% of them is distributed to the subject of the right to contracted management of land directly in order to confirm the quasi ownership status of the right.
