摘　　要：引渡关乎国家主权与相关被引渡者的人权利益。本文首先介绍引渡中的主权与人权关系,然后详细阐述了引渡中死刑犯不引渡原则、政治犯不引渡原则和本国国民不引渡原则中的主权与人权的关系,并就我国实践中相关问题提出了完善的建议。Extradition relates to national sovereignty and human rights interests of the persons are extradition. This article firstly describes the relationship between sovereignty and human rights in extradition. Secondly it elaborates the relationship between human rights and sovereignty on the principle of non -extradition to death penalty, the principle of non -extradition of political prisoners and the principle of non - extradition of nationals in extradition. At last it makes recommendations on perfecting the practice of these principles.
