摘　　要：产权制度是实现矿产资源优化配置的先决条件,为了切实实现矿产资源的国家所有权和矿产资源使用权人的合法利益,达成代际利用最大化,应加强矿产资源有偿使用和生态补偿的产权制度基础和建设。通过分析我国当前矿产资源产权制度的现状,提出加强矿产资源产权界定的立法规范、明确矿产资源使用权的交易制度、完善矿产资源开发与利用的国家监管体系等建议,从而夯实矿产资源的产权基础,保证矿产资源开发和利用的当代权益和后代利益的总体实现。The institution of property rights is a prerequisite for achieving the optimal allocation of mineral resources. Therefore, to practically enforce the state property ownership of mineral resources and definite the legitimate interests of mineral resource users, the fundamental construction of property relations concerning the compensation of mineral resources should be accelerated and strengthened, so as to ultimately maximize the utility of resources between generations. By analyzing the current status of mineral resources property rights system in China, put forward to improve legislation of mineral resource property rights, specify the trade system of the use of mineral resources, perfect the mineral resources development and utilization of national regulatory system and so on, thus laying solid foundation of mineral resources property rights, guarantee the interests of present and future generations of mineral resources development and utilization.
