摘　　要：国际互联网络的蓬勃发展带来了人类社会的巨大进步 ,但同时也引发了许多新的法律问题 ,其中包括域名的法律管制和保护。本文首先介绍了域名及其在全球电子商务中的重要地位和作用 ,分析了域名抢注行为的类型以及有关国家的司法实践 ,指出必须将域名作为一种新的、独立的知识产权客体加以保护 ,有关的法律设计应充分考虑互联网的技术因素。Although the vigorous development of Internet makes great progress for human beings, it brings many questions of law involving the legal supervision and protection of its domain name. This paper first points out the domain names important place and function in E commerce of the world, and analyzes the types of actions which leads up to rush for registering domain names and the judicial action taken against such unlawful acts in different counties . It points out the domain name may be protected as a new and absolute object of the intellectual property . When we design the legal system about the domain name, we must think over the technical factors, the international protection of the domain name and coordination between different systems of intellectual property .
