摘　　要：死刑案件的证明标准是刑事诉讼活动证明标准的重要组成部分,我国死刑案件的证明标准存在诸多弊端,学界对死刑案件证明标准是否应该高于普通刑事案件、死刑案件的定罪标准与量刑标准是否应该同一的问题存在较大争议,因此有必要在厘清上述问题的基础上对死刑案件证明标准进行完善。Criterion of proof for death penalty case is the important part of criterion proof for criminal lawsuit activities. There are many drawbacks in criterion of proof for death penalty case. There are many disputes on whether the criterion of proof for death penalty case should be higher than common criminal case and whether the convictive standards for death penalty case should be same as sentencing standard. So it is necessary to improve the criterion of proof for death penalty case based on clearing the above issues.
