论我国领事保护对象的法律问题研究

摘　　要：随着中国改革开放的深入发展,中外交往日趋频繁,海外中国领事保护问题日趋重要。文章通过对领事保护概念的界定,分析了领事保护对象的属人管辖原则及其依据国籍问题,解构了领事保护对象的一般范围,阐述了国际人权保护发展对领事保护对象变化的影响,探讨了我国领事保护对象与双重国籍的法律问题,并提出完善的建议。With the deepening development of China＇s reform and opening up, the contact between Chi- nese and foreigners are getting frequent and the issues of consular protection of overseas Chinese is increasingly important. Through the definition of consular protection concept, this paper analyses the issues of personal ju- risdiction principle of the consular protection objects and nationality which is the basis for personal jurisdic- tion, deconstructs the general scope of consular protection objects, elaborates on the effects of the changes of consular protection objects due to the development of the protection of international human rights, discusses the legal issues relating to our consular protection objects and dual nationality and puts forward some of the suggestions to improve the rules.
