农民工工资支付担保操作方式比较研究

摘　　要：解决农民工工资拖欠问题尚未形成统一成熟的操作方式。依据农民工工资支付担保是否强制,以及向谁提交的标准分为三种操作方式。通过比较,认为行政担保操作方式可以较好地弥补另外两种操作方式的不足。并从维护社会公共利益的角度分析了具有行政担保特点的农民工工资支付担保的正当性。As an attempt, tile peasant work bonds in China haven＇t fornled a unified arid well-developed operation mode. This paper divides different practices of peasant worker bonds into three different operation modes according to two standards：1.whether the bond compulsive？2.Who does the bond submit to ？Through comparison,the oper- ation mode which uses the way of administrative bond can commendably make up the shortcoming of the other wto operation modes.As a part of the administrative bond,it shows the fusion of pubic law and private law.
