摘 要:目前我国区分所有建筑物车位的使用形式单一,且过于强调效率而造成不公平现象。完善车位使用规则应以共有、专有车位的区分为切入点,分别依据各自的不同价值制定出相应使用规则,明确权利义务。具体而言,共有车位使用方式主要有专用使用权、公共车位、对外出租;对于专有车位,业主享有优先购买权、优先承租权,而非业主承租应完成一定的程序。At present, the utilization rules of parking spaces of condominium buildings is simple, and overemphasize on efficiency, as a result, inequities occurred. To improve the rules, the entry point should be the distinctions between publicly-owned and exclusive parking spaces. Based on different values of two kinds of parking spaces, we can develop appropriate use rules to make the rights and obligations clear. Specifically, the utilization forms of publicly-owned parking spaces could be the exclusive use rights, ' public parking spaces' and rent. As far as the exclusive parking spaces concerned, the owners should have right of First Refusal and the priority to rent; other people who are keen to rent the parking spaces should perform certain procedures.
