水资源特许使用权的类型化探究

摘　　要："水资源特许使用权"指特定的行政主体基于特定的相对人的申请而授予该相对人以继续且排他性地占有一定水资源的权利。本文从形式和实质两方面探讨水资源特许使用权类型化的标准,并从理论应然的高度检讨取水权、使用水域从事养殖和捕捞的权利以及水体排污权三类水资源特许使用权的立法实然现状。Authorized right of water resources is a kind of authorized right for the use of water resources.Authorized user,that is,water right user,is in possession of specific water resources continuously and exclusively.Authorized right of water resources belongs to one of authorized rights in essence.This paper gives a theoretical discussion on the classified standard of authorized right of water resources from the two aspects of form and substance,and reviews the real and present legislative situation of the right of using water,the right of farming and fishing and the right of emission in using water areas.
