摘　　要：从国内外学界既有的理论认知来看,法律方法中的体系解释主要关涉两个维度:内在体系与外在体系、广义体系与狭义体系。它可能意指三个层面:可能意指因同一法律内部的规定之间的逻辑与价值关联而产生的解释,或者不同法律部门的规定之间的逻辑与价值关联而产生的解释;可能意指因法律与法律之间的不同规定发生矛盾与冲突时所引发的解释;在宽泛意义上甚至还可能意指法律与宪法规定相互冲突时所引发的解释。作为一种文本主义的法律解释方法,体系解释具有强大的方法论功效,那些具有比较完善的体系特征的法律部门是其发挥最重要作用的领域。当然,体系解释必须面对法律体系自身的难题,诸如法律规范会出现相互矛盾和彼此冲突的情形等;体系解释与其他解释方法具有不可分割性。运用体系解释的方法,必须有意识地、能动地克服其不足之处,最大限度地发掘其方法论的价值。From the theoretical cognition existing in both domestic and overseas academia, the canon of systematic interpretation in legal methods involves the inner and outer legal system, and also refers to the narrow sense and broad sense of systematic interpretation. It can mean the interpretation from connection of logic and value with the rules in the same law or in the different law divisions; it can mean the interpretation caused by the collision of different rules in different law divisions, including the collision rules between common law and the constitution. As an interpretative method of textualism, systematic interpretation has powerful methodological function, and those legal divisions which are characteristic of relatively complete systematic feature are where systematic interpretation can play its most significant part. But at the same time there are limitations to it. Of course, systematic interpretation has to confront difficulties in legal system itself, such as the conflicting or collision between legal norms; and systematic interpretation cannot be separated from other legal interpreta- tive methods. When using legal systematic interpretation, we must overcome its defects consciously and actively, and explore its value of methodology to the greatest extent.
