公民社会权与社会救助的互释、互构何以可为

摘　　要：本着"体""用"结合的理念,提出公民社会权与社会救助理论上互释、实践中互构的观点,以期消除公民社会权与社会救助概念上的模糊与分歧,促使公民权利意识的觉醒,在完善社会救助模式的同时,并推动公民社会权各权项的协调。这种互释、互构不仅使社会救助有效地发挥其保障公民社会权的作用,还促成公民社会权对社会救助的导航和标引,在转型期的中国社会,具有一定的现实意义。In the spirit of connecting ＂style＂ and ＂use＂, the concept of mutually interpreting and constructing the right of civil society and social assistance is put forward to eliminate blurs and divergence of concept in the fight of civil society and social assistance, in order to awaken the consciousness of civil right, and coordinate the civil society rights as well as perfect rescue mode. This mutual interpretation and construction not only make the social assistance effectively play its guarantee of citizen＇s social rights, but also contribute to the navigation of social rights to the social assistance in the transition of Chinese society, which has certain practical significance.
