摘  要:随着奇虎诉腾讯垄断案在广东省高级人民法院开庭,对此案件是否适用反垄断法的争议越来越广泛。此文试图从反垄断法的滥用市场支配地位制度的基本分析框架出发,分析得出本案中腾讯公司的行为不属于滥用市场支配地位的行为,并对腾讯公司的行为需负的法律责任做出认定。最后就互联网企业的反垄断适用问题提出几点建议。After QIHU360 vs. Tencent case was tried in Guangdong Higher People's Law Court, the controversy about whether the anti-monopoly law should govern this case has been spreading. This article begins at the basic analysis of the system of market dominant position abuse provided in the Anti-monopoly Law, and concludes that Tencent)s behavior does not fall under the abuse of market dominant position, as well as identifying legal liability resulting from Teneent's behavior. Finally, it proposes some suggestions about the legal problem of applying Anti-monopoly Law to internet enterprises.
