摘　　要：在"中国与ICSID"国际投资法与仲裁高级研讨会期间,专家围绕国际投资法与仲裁领域热点和前沿问题进行了研讨;认为国际投资法正处在持续深化和不断发展之中,国际投资法在价值定位、条约形式和具体规范等方面均取得了巨大的进展,但同时也面临诸多的争议;国际社会应该以和谐共生、共同繁荣的理念,兼顾不同的利益需要,共同致力于构建一个和谐的国际投资法律秩序;中国作为发展中国家的投资大国,应该在国际投资法治建设中发挥更加主导性的作用。The ＂ICSID and China＂ International Workshop and Roundtable on International Investment Law and Arbi- tration held in Xi＇an Jiaotong University Law School was a great success, with more than 130 international and national officers, experts, scholars and participants actively debating on important and advanced issues on international invest- ment law and arbitration. It is observed that international investment law （IlL） is undergoing profound changes. Pro- gress has been made not only on treaty structure and provisions but also on its policy and value orientation. In order to construct a harmonious international investment legal order, various interests and needs of different players in interna- tional investment activities should be respected and balanced, particularly those between the regulatory power of the host state and the legitimate interests of the foreign investors. As the largest developing country with dual - role in internation- al investment activities, China should actively participate in the rule - making in international investment. The workshop and roundtable have propelled in - depth exchange between scholars and practitioners from both China and abroad, pro- viding insightful suggestions for the perfecting of international investment law in general and the Chinese investment trea- ty practice in particular.
