摘　　要：赡养义务是一种法定义务,赡养协议是对赡养义务的具体化。赡养协议的产生有其深刻的社会背景,随着老年人社会地位和家庭地位的下降、青年人赡老养老意识的淡化以及农村社会养老保障制度的不健全,使家庭养老仍占重要地位。赡养协议作为一种新型的温和的预防和解决农村养老纠纷的方式。它有利于切实实现"老有所养",维护老年人合法权益;能够为养老纠纷的解决提供一种温和的非诉讼的求解模式,有助于减少或化解赡养人之间,以及赡养人与被赡养人之间的矛盾;有利于家庭养老机制的巩固和完善。Maintenance obligations are a kind of legal obligation.The maintenance agreement is specific to maintenance obligations. Maintenance agreement has produced with the decline in social status and family status for the elderly,and the desalination of maintenance awareness from young people.Maintenance agreement came into being as a new kind way to prophylaxis and resolute the maintenance disputes in rural areas.It is conducive to the effective realization of the ＂sense of security＂ ,safeguarding the legitimate fights and interests of the elderly;able to provide for the settlement of the pension dispute with a mild,non-litigation solving mode,help to reduce or resolve between dependents,as well as a maintenance man and the contradiction between the maintenance people;mechanism conducive to family pension to consolidate and perfect.
