摘　　要：目前,我国高速公路收费实行的是行政审批制度。行政审批制度是计划经济的产物,适用该种制度,从价值上讲容易导致权力寻租,滋生腐败;从效力上讲不能对外产生法律效力;从程序上讲有悖于正当程序原则,最终将导致公路收费存在诸多问题。随着相关法律制度的完善,高速公路收费已经不宜适用行政审批制度,有必要重新确立适用高速公路收费标准的法律制度。At present our country highway toll is the implementation of the administrative examination and approval system.The administrative examination and approval system is a product of the planned economy.The Application of the system easily lead to power rent-seeking,corruption from the angle of value;The act should not produce foreign legal effect from the effect;it is against the principle of due process from the proceedings to apply the system.The Application ultimately will lead to problems for the highway toll.With the perfection of the legal system,highway toll has not suitable for application of administrative examination and approval system,It is necessary to establish the suitable highway charges due legal：Through the implementation of administrative licensing system to guarantee the public highway,Through the fairness hearing procedure to guarantee of toll roads,Through the administrative contract to return highway to the people.
