摘　　要：侦查活动和媒体之间是契合与冲突并存的矛盾统一体,它们既有追求目标(正义的一致性、效益追求)的互补性,又具有基础理论(信息公开和侦查秘密)和保护利益的对立性。研究媒体与侦查的关系有利于从立法规范、侦查机关自身制度与素养的建立与培养、司法救济途径等方面探讨公安机关和媒体之间理性关系的构建,以实现社会利益的最大化。The relationship between investigative activities and media is a contradictory unity compatible with conjunctions and conflicts. They both pursue the same complementary goals （justice and efficiency） and have same basic theories （information disclosure and secret investigation） and confrontation for benefit protection. From legislation, the system self-construction and self-development of the investigation organs and the judicial relief ways, basing on studying the relationship between investigation and media, we can probe into their rational relationship construction to realize the maximization of social benefits.
