西沙群岛资源开发与保护法律问题初探

摘　　要：西沙群岛具有重大的战略、海洋权益、经济资源、生态环境及社会文化价值,在西沙群岛开发的过程中,应当遵循规划先行原则、综合效益效用原则、适度开发原则,在实现主权、国防、生态安全的基础上,促进西沙群岛资源的有效利用和合理配置。通过构建资源的有偿使用制度,明确有偿使用的方式、主体、客体和内容以实现西沙海岛资源的优化配置;建立国家扶持制度,通过对西沙旅游业、渔业和油气开发业等特色产业的扶持、财税政策扶持和西沙的基础设施建设的政府扶持等制度作为西沙开发的重要保障;通过设立国家级珊瑚礁自然保护区以及构建生态补偿机制等特殊的生态环境保护措施和制度,以实现西沙群岛开发的可持续发展。For a long time, China has been facing the dilemma about the South China Sea, among which the first of all is concerned with national sovereignty, that is the ownership of the South China Sea islands and their surrounding waters. So far, we have defined the baselines of the territorial sea of the Xisha Islands. But as to the Nansha Islands which involves in the greatest dispute, the baselines haven＇ t been decided and the legal nature of its surrounding waters is unknown. In addition, problems such as the ownership and exploitation of oil and gas resources in Hainan caused by sovereignty, the development and utilization of the South China Sea Islands and national criminal jurisdiction to disputed waters, are very notable and call for immediate solution. Now that problems about the South China Sea are very sensitive and complex, ways and solutions are much more concerned. For this purpose, our journal invite experts and scholars from Law School of Hainan University and Hainan Law Research Center of the South China Sea, who will discuss the above problems based on the national -funded social science projects they host and participate in, in the expectation of bringing more con- cern and encouraging further research.
