摘　　要：审前羁押定期审查是新《刑事诉讼法》新增加的一项内容,该项制度设立的背景有二:审前羁押比例高、期限长;超期羁押、不当羁押等审前羁押救济原则缺失。该项制度也有其设立的必要性:有利于实现刑事诉讼法惩罚犯罪与保障人权的双重目的;实现控辩双方平等对抗的原则;实现对公权力的制衡;贯彻和实现无罪推定原则;贯彻诉讼迅速原则。针对新《刑事诉讼法》规定的审前羁押定期审查制度,应从审查原则和审查程序加以完善。Pretrial detention review on a regular basis is a new added content in the new ＂Criminal Procedure Law＂ , the establishment of the system has two background： the pretrial detention ratio is high, long duration; extended detention, detention and pre-trial detention relief principle deletion. This legal system also has the necessity of establishment： to achieve the dual purpose of criminal procedure law, punishment of crime and protection of human rights; to achieve both sides equal confrontation principle; realize the balance of public power; to carry out and realize the principle of presumption of innocence; carry out the pr/nciple of litigation rapidly. According to the provisions of the pretrial detention regular review system in the new ＂criminal procedural law＂ , it should be improved from the review principle and the review procedures.
