论武警职权的特殊性

摘　　要：武警职权是武警部队执行安全保卫任务的重要保障，有其自身的特殊性。首先，武警职权必须由法律赋予武警部队，而不能通过行政授权的方式取得；其次，从武警部队承担的职能任务、行政职权的行使主体以及武警职权的运行原则分析，武警职权属于行政权，而非军事权；最后，在行使武警职权过程中必须注意职权行使的限定性、非处分性、不受司法审查以及职权行使的程序等四个方面的特殊之处。Authority of CAPF is an important guarantee when CAPF performs tasks of security, and there are some specific characteristics in it. First, Authority of CAPF must be con- ferred by the law to CAPF, not by administration. Second,considering the tasks CAPF undertakes,its role of being the main body of admin strative authority and the operation principles, authority of CAPF belongs to the administrative power, not the military power. Last, the exercise of authority of CAPF must pay attention to special problems in the following four aspects, authority restrictions, non punishment, free from judicial review and proce- dures for CAPF to exercise authorities.
