摘　　要：随着互联网的迅速发展,有别于严肃的正统文化的狂欢似的亚文化以前所未有的速度迅速兴起。以戏谑和模仿为主的戏访作品作为著作权法上的独立作品,在宪法所保障的文艺创作和言论自由的权利之下。然而,又由于其所倚仗的戏谑和模仿的对象原作品本身就拥有受法律保护的著作权,戏访作品从出现之初就陷入侵权的漩涡中,在各利益的冲突之下,合理使用制度为戏访作品提供了一个合法的平台。With the rapid development of the internet,orgiastic subculture which is different from serious culture spring up with unprecedented speed.As the independent work on the copyright law,parody predominantly with banter and imitation is under the protection of the constitution for literary creation and the freedom of speech.As the original work itself is also under the protection of the copyright law,parody fell into the vortex of infringement from the beginning.Under the various conflicts of interest,Reasonable use system provides a legitimate platform for parody.
