传统监禁刑的弊端及出路

摘　　要：传统监禁刑在发展过程中呈现出一系列弊端:不仅矫正效果有限,反而使罪犯变得更坏;监狱行刑过程中存在的诸多严重不人道现象,也损害了其正当性基础。传统监禁刑进行自我完善与改革,一方面,要推进监狱行刑社会化、科学化、人道化,促进监狱社区化、小型化;另一方面,要尽量避免短期监禁刑的适用,倡导社区刑罚。After more than two hundred years of development,traditional imprisonment shows a series of defects：it not only has no correction effect instead of making the criminals worse.At the same time,many serious inhuman phenomenons in the prison execution process also damaged the legitimate basis of traditional imprisonment.In the face of criticism,on the one hand,traditional imprisonment should improve and reform,promote the socialization of prison execution,and the prison community,miniaturization;on the other hand,we should try to avoid the short-term imprisonment penalty and promote community penalty.
