摘　　要：夫妻共同遗嘱作出后,后死亡的一方在生存期间,因为各种原因撤销或者变更原来所立的夫妻共同遗嘱比较常见,导致原来所指定的继承人或受遗赠人与新的继承人或受遗赠人之间发生继承纠纷。该如何对待夫妻共同遗嘱,如何平衡各方当事人的利益,需要对实务界和学术界的不同看法进行分析,选择最有利的立法模式,明确禁止夫妻共同遗嘱,以减少不必要的纠纷,让继承立法简单明了。After the making of the couple＇ s joint wills, after the death of the party to survive during the period, due to various reasons revoked or the couple jointly wills change the original legislation common cause originally desig- nated heir or legatee succession dispute between the heir or legatee. How to treat the couple＇ s joint wills, and how to balance interests of the parties, the need for analysis of the different views of practitioners and academics, to se- lect the most favorable legislative mode, explicitly prohibited the couple＇ s joint wills, in order to reduce unnecessa- ry disputes, simple inheritance legislation.
