摘　　要：交往行动理论视域下的权利生成于商谈,介于公权力与私权利之间,它以私权利为起点,通过主体间的交流产生交往权力这个介质,并通过建制化过程确证为公权力。解析公民权的关键在于私权与公权能否互动以及如何互动。身份确证是解决中国农民工公民权问题的前提,交往行动理论视域下的共同体构建与农民工公民素质的提升是实现中国农民工公民权的关键。From the perspective of communication right has been generated in the talks,which is between public power and private rights.It takes the private right as the starting point,produces the communication power by the intersubjective communication,and be confirmed with public power through the process of institutionalization.The key of analysis of civil right lies in whether and how private rights and public rights could interact.Identity is the premise to solve the civil rights of Chinese peasant workers.From the perspective of communication,the construction of community and the improvement of civic quality should be the key to realize the civil rights of Chinese peasant workers.
