摘　　要：受试者参与一项全球性的新药试验，出现严重不良反应事件，索赔过程几经波折。因在司法解释中找不到与其法律关系相对应的案由名称，代理人创造性地以合同纠纷为由提起诉讼，为司法实践中关于新药试验纠纷的处理。Subjects participated in a global drug trials suffers serious adverse reaction, and the claims process twists and turns. Because there is no legal cause of action in the judicial interpretation corresponds to the legal relationship in this case, the agent of the claimer creatively filed a lawsuit in the name of contract dispute which blazes a trail regarding new drug testing dispute in judicial practice.
