论风险规制的行政法原理及其实现手段

摘　　要：在不确定性增长的时代,风险是现代社会的显著特征。如何将风险控制在最低程度,并敏锐地抓住时机将它转化为发展的动力,考验现代政府的应对能力。在实践中,为防止政府行为不当,造成更严重的"次生"灾害,有必要从行政法的角度,导入秩序行政、法治主义、基本权拘束、福利国家、比例行政、有限行政、信赖保护等原理,在理念上指引政府行为;在制度建设上,应从过程论的视角,建立健全公共设施建设、信息沟通、专家知识利用、风险心理普及、社会保障、公众参与、资源分配、公共捐赠、项目研发以及风险法制等,为规避风险提供科学手段,构建严密体系,以回应人民对安全、自由与民生的增长需求。In the era of uncertainty growth,the risk is a significant feature of modern society.How to make the risk under control to a minimum degree and transform it into an engine for development with a sharp eye of seizing the opportunity has become a test of the modern government＇s capacity to respond.In practice,in order to prevent misconduct by the Government and avoid resulting in more serious ＂secondary＂ disaster,it is necessary to illustrate and emphasize such basic principles from the viewpoint of the administrative law like the order administration,the legalism,the fundamental rights constraints,the welfare state,the proportion of administration,the limited administration and the trust protection to guide the government action in theory;To the institutional establishment should such scientific implementation means of the risk regulation involving the process theory of the administration be provided and applied as the construction of public facilities,the communication of information,the use of expert knowledge,the popularization of the risk psychology,social security,public participation,resource allocation,public donations,the project R D and the risk legislation for the purpose of building a rigorous system and avoiding risks in response to the growing demand of the people for security,freedom and people＇s livelihood.
