摘  要:以法为据、以法为尺的法治思维范式能促使我国高等教育在合法、高效、公平、公正的法治轨道上运行,并全方位、动态地实现高等教育法治化。高等教育管理者在法治理念的基础上,应该运用法律原则、法律规范、法律精神和法律逻辑对高等教育事务进行法治分析、综合、判断、推理,并形成法治结论。通过坚持依法治教思维的核心理念、公平正义思维的价值追求、权利义务思维的基本要素、制约监督思维的坚强后盾等法治思维对我国现有的高等教育基本法——《中华人民共和国高等教育法》进行全面的修改与完善,可以促进我国高等教育的可持续发展。The paradigm of thinking that runs according to the feet of the rule of law can promote China's higher education in the legal,efficient,fair and impartial rule of law track to achieve all-round dynamic rule of law of higher education.The process is the thinking and understanding activity that managers of higher education on the basis of the concept of the rule of law use the legal principles,legal norms,the spirit of the law and legal logic to draw the conclusion of the rule of law through analysis,synthesis,judgment,reasoning in higher education affairs.We can conduct a comprehensive revision and improvement for the basic higher education law——Higher Education Law of the People's Republic of China and truly achieve the sustainable development of higher education of our country according to the thinking of the rule of law that consists of the core concept of administering education thinking,the value pursuit of justice,the basic elements of the rights and obligations and the thinking of monitoring and restricting.
