摘　　要：我国实行计划生育政策,严格禁止非医学需要胎儿性别鉴定和选择性别的终止妊娠行为。文章综合分析了我国现行处罚非医学需要胎儿性别鉴定和选择性别的终止妊娠行为的做法,从法理上探讨了公民再生育权与计划生育政策的关系,对非医学需要胎儿性别鉴定和选择性别的终止妊娠行为提出了行政处罚立法建议。Our country＇s family planning policy strictly forbids fetus sex identification without medical motive and pregnancy termination for fetus＇ sex choice.The paper analyzes the punishment on sex identification without medical motive and pregnancy termination for fetus＇ sex choice,discusses the relationship between citizens＇ more child-bearing right and family planning policy from jurisprudence,and puts forward the suggestion on administrative punishment and legislation of fetus sex identification without medical motive and pregnancy termination for fetus＇ sex choice.
