中国航运物流责任保险发展中的法律制约

摘　　要：中国的物流责任保险立法以及保险条款的制定应兼顾中国航运物流活动的具体内涵以及海上保险的特色,兼顾物流责任保险人风险评估难的特点,着眼于发展相互保险公司或互保协会的保险组织形式,并根据具体风险种类制定综合的保险单或保险方案以及有针对性的投保"调查问卷",而不是寻求单一的商业保险公司承保并制定单一的物流责任保险条款。当前要注重对妨碍航运物流责任保险发展的立法和保险条款的完善。Legislation of logistics liability insurance and liability insurance clauses in China shall consider the scope of marine insurance and difficulties in assessing risks faced by insurer of logistics liability insurance, with a view to develop mutual insurance companies and mutual insurance associations and formulate a comprehensive insurance policy or insurance plan in the light of specific risk levels and design corresponsive and customized questionnaire, instead of seeking to establish a simplex and unified logistics requires not only perfecting the legislation as well as insurance law and cultivate professional talents, such as insurance adjusters, claims executives and insurance brokers etc..
