试析我国第三方支付领域的外资准入问题

摘　　要：近年来,第三方支付在我国的发展十分迅速。"支付宝事件"以国家金融安全和外资准入限制为理由的去外资模式引发了人们对我国在金融服务第三方支付领域的外资准入问题的关注。在国际条约层面,参考中国银联与VISA金融服务市场开放之争的"美国诉中国电子支付服务相关措施案"的裁决,可以认为在第三方支付的"商业存在"方面,我国承担了给予其他成员方服务提供者以市场准入的义务,但是可以有资质条件方面的限制。而在国内立法层面,主管部门对于金融服务领域限制外资目前仅有寥寥数语的的原则性规定,而并无具体细则。在实际操作层面,一些存在外资协议控制的第三方支付企业获得牌照,说明这一领域对外资的大门并未关闭。在可预见的将来,主管当局对于第三方支付可能采取有条件地积极干预,在确保国家金融安全的考量之下实施渐进式开放的策略。Third-party payment has expanded rapidly in China during recent years. The ＇ pay treasure event＇, which removes the foreign capital by the name of national financial security and market access restrictions on foreign investment, has caused the public to pay close attention to the market access of foreign investment in the field of third-party payment. In the level of international treaties, referring to the decision of ＇The United States v. China electronic payment service related measures＇, it is clear that China has the legal obligation to give market access to other WTO members in respect of commercial presence in the field of third-party payment, and at the same time, China can set qualification conditions for third-party payment organizations. On the other hand, in the level of domestic laws, the competent authority only has several provisions of principle about the restrictions on foreign investments, but does not have specific rules in the regulations. Some third-party payment companies adopting the mode of VIE have already acquired licenses in practice, which means that the door of third-party payment has not been completely shut down to foreign investments. In the foreseeable future, the competent authority may regulate third-Party payment to a certain extent, and open it gradually without sacrificing the national financial security.
