摘 要:"依法行政"由紧密联系的三个逻辑环节所构成:"法"的存在是前提;"行政"是指过程及其结果;"依"则是指由法达至行政价值目标过程中所使用的方法和所遵循的路径。与此相关联,公务员应当具备较高的学法能力、对法的理解与解释能力、用法解决涉法性问题的实践性能力等。然而,由于受到外在与内在各种因素的影响,我国公务员依法行政能力的总体水平依然较低。为更好地实现行政价值目标,就必须努力提升公务员依法行政的能力。Law-based administration, which is constituted of three closely connected logic sessions. Law is the premise of existence. Administration, which means process, and its out-come. According to, which means its used way and followed route in the process for law to a- chieve the goal of administrative value. Associated with these, civil servants should possess supe- rior ability of learning the law, and the ability of understanding & explanation of law, and the practical ability of solving law - related problems by law. Howsoever, as a result of the impact of diversified subjective factors and objective factors, the general level of the ability of law -based administration of Chinese civil servants are still low. In order to achieve the goal of administrative value better, the ability of law - based administration of Chinese civil servants must be hardly promoted.
