摘　　要：纵观历史的发展,刑事错案一直伴随着人们的生活,刑事错案导致许多无辜者的存在。保护无辜者的利益是国家赔偿法的宗旨,因此,进一步探讨刑事赔偿制度的缺陷,完善刑事赔偿制度,对于我国刑事错案中无辜者的赔偿具有现实意义。It happens in every country and every times that criminal misjudged cases have been with people＇ s life, which results in many innocent people. To protect the interests of innocent people is the purpose of the national compensation law, and therefore further discussion on shortcomings in the crim- inal compensation system and perfection of the criminal compensation system have great significance.
