摘 要:自新中国成立至今,慈善法一直是我国社会法建设的薄弱环节。其存在实质合理性缺乏、合法性不足以及协调性、完备性和可操作性欠缺等弊病。因而有必要在宏观和微观两个方面推进我国慈善法建设与发展。在宏观上,明确慈善立法作为社会政策的相对独立性,正确定位政府的地位与作用,确立慈善立法的基本模式及其内容定位;在微观上需要对慈善组织、慈善募捐、慈善信托、志愿服务、激励措施以及监督管理等制度做出既符合中国本土传统,又体现对国外先进立法成果借鉴的科学设计。Since the founding of New China, charity law has been the weak link of the social legislation construction. It is lack of substantive rationality and legitimacy, as well as coordination, completeness and operability. So it is necessary to promote the construction and development of Charities legislations in the macro and micro aspects. In a macroscopic view, it is important to clear the relative independence of charity legislations as social policy, to adjust the status and role correctly of the government, to establish the basic pattern and content of charity legislations; In a micro view, it is critical to make scientific design our system with regard to charitable organizations, charitable donations, charitable trusts, voluntary services, charitable incentives and supervision and management not only complying with chinese traditions, but also reflecting foreign advanced legislative achieve- meats.
