摘　　要：现行的森林生态效益补偿制度存在严重的法律冲突。国家林业局、财政部的规范性文件与《宪法》、《民法通则》、《物权法》、《立法法》、《森林法》、《森林法实施条例》等一系列上位法相冲突。本文对这些法律冲突进行了详细的描述。森林生态效益补偿制度法律冲突的本质是漠视农民的财产权。There are serious legal conflicts of current forest ecological benefit compensation system. The normative documents of the State Forestry Administration and the Ministry of finance are to collide b with the ＂constitution＂ ,＂ general principles of civil law＂, ＂ property law＂,＂ legislative law＂,＂ for- est law＂, etc. This paper gives a detailed description on the conflict of laws. The essence of legal con- flict of forest ecological benefit compensation system is to ignore the property rights of farmers.
