小产权房的法律治理问题探析

摘　　要：小产权房存在既是对合法购房者权益的忽视,更是对国家法律权威性和严肃性的侵犯。大量开发"小产权"房不仅带来大量耕地的流失,也给失地农民的基本生活保障带来较大威胁。由于没有完整的出售住房的合法证件和手续,小产权房的法律保障面临诸多问题。小产权房问题亟待法律规制。The existence of small property houses is not only a disregard to the legitimate rights and interests of buyers ,but also a violation to the authority and seriousness of national hws.The development of small property houses causes the loss of a large amount of cultivated land and a threat to the land-lost farmers＇ basic living. Because the sale of small property houses lacks complete legal documents and preeedures, the legal protection of small property houses faces many problems. In conclusion, the problem of small property houses needs to be solved by the law.
